–Mr. Dub represents both franchisors and franchisees. He has written franchise agreements and FDD’s for franchisors, and has provided document review for dozens of clients needing legal review of their documents before buying a franchise. He has represented many franchisees threatened with termination, or who wish to exit their franchise systems.
— Mr. Dub has personally brought, defended or served as expert consultant in connection with most of the court cases brought in the past fifteen years that involved Ohio’s franchise law. His 2017 case in Arizona federal court established the rule that Ohio’s law applies in disclosure violation cases involving Ohio franchisees, even if the Franchise Agreement says that a different state’s law applies. (Zounds Hearing Franchising, LLC v. Bower, D.C. Arizona, 2017 U.S. Dist Lexis 151940).
–A member of the ABA’s Forum on Franchising since 1990, Mr. Dub started his private law practice in 2006 and devotes 90% of his time to franchise-related legal problems.
— Mr. Dub serves as Adjunct Professor of Franchise Law at Case Western Reserve University Law School in Cleveland, teaching an annual course on Franchise Law since 2016. This is the only course on Franchise Law taught at any law school in Ohio.
— Mr. Dub served on the committee of the Ohio Bar Association that wrote the 2012 amendments to Ohio’s franchise law, and he wrote some of the language included in the current version of the law.
— Two of Mr. Dub’s articles have been published in the Franchise Law Journal, the national scholarly journal published by the American Bar Association. He also presented a Workshop on Franchise Agreement terms at the 2020 Symposium of the Forum on Franchising (“Dueling Perspectives on Selected Franchise Agreement Provisions”).
